Terms of Service

These Terms of Service govern the use of the Kolabik platform and define the rights and obligations of users. By using our services, you accept the following terms.
1. Definitions
Service / Platform - the Kolabik website available at kolabik.com, offering financial calculators and data processing tools
Service Provider - Konrad Szczepański operating as Kolabik (sole proprietorship), Tax ID (NIP): 7394006659, REGON: 529807486, registered address: ul. Wincentego Pstrowskiego 14D/17, 10-602 Olsztyn, Poland
User - any natural person, legal entity, or organizational unit using the Service
Account - a collection of resources and permissions created for the User in the Service
Premium plan - paid access plan to the full Service features for a 30-day period
2. Service Scope
Kolabik offers the following services:
- Financial calculators: delay interest, capital interest, tax arrears interest, exchange differences
- Financial data processing and analysis
- Export results to CSV and Excel formats (Premium plan)
- Unlimited number of records across all calculators (Premium plan)
- Custom services: data integrations, dedicated calculators
The scope of features depends on the selected plan.
3. Registration and User Account
- Registration requires providing accurate personal information (first name, last name, email, username)
- User is obligated to maintain password confidentiality and secure the account
- One account may only be used by one person
- User is responsible for actions taken from their account
- Account may be blocked in case of Terms violation or suspected abuse
4. Plans and Payments
Available plans:
• Free Plan - limited access to calculators (max. 3 records)
• Premium Plan - full access to all calculators, unlimited records, data export (CSV/Excel) and technical support, valid for 30 days
Payment terms:
- Payments are made based on generated invoices
- Premium access is granted once for a 30-day period
- Access to paid features is activated after payment confirmation
- Invoices are issued through the Infakt system according to User-provided data
- User is obligated to provide accurate invoicing information
Plans do not renew automatically. The user explicitly decides to extend the validity. After the paid period ends, access to the package features expires.
Fees for unused plan periods are non-refundable, unless otherwise required by law (e.g., consumer withdrawal right).
5. User Obligations
User agrees to:
- Use the Service in accordance with the law and good practices
- Not undertake actions that could harm the Service or other users
- Not share account access with third parties
- Not use the Service for purposes inconsistent with its intended use
- Not copy, modify, or reverse engineer the software
- Comply with limitations resulting from the selected plan
Use of the Service for illegal, fraudulent activities or activities violating third-party rights is prohibited.
6. Intellectual Property
All copyrights and intellectual property rights to the Service, calculators, algorithms, user interface, logo, and materials belong to the Service Provider. User is granted only a license to use the Service in accordance with these Terms.
Data entered by the User remains their property. The Service Provider processes it solely for the purpose of providing services.
7. Liability and Disclaimers
- The Service is provided 'as is'. The Service Provider strives to ensure calculation accuracy but does not guarantee error-free operation
- User bears full responsibility for decisions made based on calculator results
- Calculators serve informational purposes and do not constitute legal, tax, or financial advice
- Service Provider is not liable for damages resulting from User's incorrect data input
- Service Provider's liability is limited to an amount equal to fees paid by the User in the last 12 months
- Service Provider is not liable for Service unavailability resulting from force majeure, external provider failures, or planned maintenance (after prior notice)
We recommend consulting with a professional (lawyer, accountant) in legally or financially significant matters.
8. Service Availability
Service Provider aims to ensure continuous Service access (24/7), however:
- Does not guarantee uninterrupted availability
- Reserves the right to technical and maintenance breaks
- Notifies in advance about planned interruptions (when possible)
- Is not liable for interruptions caused by external factors
9. Service and Terms Modifications
Service Provider reserves the right to:
- Modify Service functionality for improvement
- Change pricing plans (maintaining terms for active plans)
- Update Terms - users will be notified of significant changes with 14 days' notice
- Introduce new features or services
Continued use of the Service after changes take effect indicates acceptance of the new Terms.
10. Contract Termination and Account Deletion
User may delete their account at any time through account settings or by contacting the Service Provider. Account deletion results in permanent data deletion (except data required by law, e.g., invoices).
Service Provider may terminate the contract and delete the account in case of:
- Serious Terms violation
- Actions harmful to the Service or other users
- Non-payment for plan for more than 30 days
- Providing false registration information
User will be notified of contract termination with 7 days' notice (when possible).
11. Personal Data Protection
Personal data processing rules are defined in the separate Privacy Policy available on the Service website. Using the Service indicates familiarity with and acceptance of the Privacy Policy.
12. Dispute Resolution
These Terms and any disputes arising from Service use are governed by Polish law.
Matters not covered in the Terms are governed by the provisions of the Civil Code and the Act on the provision of electronic services.
If the User is a consumer, they are entitled to rights under consumer protection laws, including:
- Right to withdraw from a distance contract (14 days from contract conclusion, with exceptions)
- Right to file complaints
- Possibility to use alternative consumer dispute resolution (mediation, consumer arbitrator)
Court jurisdiction is determined according to the Code of Civil Procedure. For entrepreneurs: court with jurisdiction over the Service Provider's registered office.
13. Final Provisions
- In case of invalidity of any Terms provision, the remaining provisions remain in force
- All communications and notifications are sent to the email address provided during registration
- Terms enter into force on the date of publication
- Service Provider informs about the possibility of using alternative dispute resolution and complaint procedures
